Troy D. McMahan
In Brief
Mr. McMahan has over seventeen years of experience defending various Fortune 500 companies in cases involving premises and products liability claims, maritime claims and business disputes involving the improper use of proprietary information.
Representative Matters
Toxic Tort
Mr. McMahan currently represents the manufacturer of commercial grade silicone, which has been sued by individuals who misused that product by injecting it into their bodies for cosmetic purposes.
Mr. McMahan has successfully defended Aventis Cropscience Inc. in a case in which the plaintiff, a paper maker, claimed that Aventis’ liquid aluminum sulfate contributed to the development of his interstitial pulmonary fibrosis.
Mr. McMahan also successfully represented Rhodia Inc. in a case where the plaintiff claimed that occupational exposure to various food additives manufactured and supplied by Rhodia, caused the plaintiff to develop a lung disease.
Maritime
Mr. McMahan currently defends Chevron Shipping Company and Texaco Marine Services Inc. in cases in which persons who worked aboard the companies’ ships assert personal injury and wrongful death claims under federal maritime law – Jones Act, Longshoreman and Harbor Workers’ Compensation Act, and federal maritime common law.
Recently, Mr. McMahan prevailed on summary judgment on behalf of Chevron Shipping Company LLC in a case of first impression – whether federal maritime law imposes a duty upon a ship owner to protect off-shore third parties from injuries occurring as a result of activities performed aboard ship. Specifically, plaintiff claimed he was exposed to a toxin (asbestos) used aboard Chevron’s vessels, and which his father - an officer aboard the vessel – allegedly brought home on his uniform.
Asbestos
For nearly 15 years Mr. McMahan has managed asbestos premises and products liability dockets throughout the State of California. He currently represents Chevron U.S.A. Inc, Texaco Inc. Unocal Corporation, The Dow Chemical Company, Rhodia Inc., Hayward Electric, Graham Corporation and Ruggles-Klingemann Manufacturing Co. Inc. in those matters.
Automotive
Mr. McMahan obtained a defense verdict at trial on behalf of the Ford Motor Company on an insurance subrogation claim brought by Farmers Insurance Company against Ford based on claims of a defective ignition switch.
Mr. McMahan also successfully defended the Ford Motor Company against plaintiff’s product liability claim based on allegations that a defective seatbelt caused plaintiff to sustain injuries during an automobile accident. The trial court granted summary judgment in favor of Ford.
Government Tort Liability
Mr. McMahan has represented the Bay Area Rapid Transit District in various personal injury and property damage claims arising from construction activities occurring during the BART extension projects.
